(as in most US cases in Iraq, Afghanistan and Gitmo) 2) Torture should NEVER be legalized, because in extreme "ticking time-bomb" cases, the jury can always side with the torturer if they see a genuine necessity for it. . Waterboarding has routinely been held to be torture by US run war crimes tribunals. It's time that precedent was applied to Dick Cheney. Now that Cheney has openly admitted to, and almost bragged about, some of his war crimes it’s time to try him, sentence him to death and execute him just like so many Japanese were hanged in Asia for this sort of thing in 1946.
