Appeals from the Minnesota Supreme Court go to the US Supreme Court, not to a federal Court of Appeals.

The problem with the order is that no matter who comes out ahead, the loser will have solid grounds for an appeal to federal court. And the 8th Circuit (which includes Minnesota) is the most conservative federal appellate court in the country. As I recall, all but two of its members have been appointed by Bush 1, Bush 2, or Reagan. They will undoubtedly do whatever they can to find for Coleman. And the US Supreme Court will wash its hands of the matter, leaving it sit however the 8th Circuit rules.

Which sets us up for a determination by the Senate, under its rules and our Constitution - but it will
be made to look partisan and corrupt by the most partisan and corrupt people we have in this country.

Nixon's Revenge just goes on and on.

Sorry right wingers..time to move to Canada or wherever rednecks go when thay er mad.

Looks like the liberals are taking over.

"Democratic challenger Al Franken finds himself on the cusp of winning a seat in the United States Senate after Minnesota's canvassing board awarded him a host of challenged votes during deliberations on Thursday.

As of 8PM ET, the Minneapolis Star Tribune projected that Franken would finish the recount process with a lead of 89 votes, positioning him to become the 59th senator caucusing with Democrats in the upcoming Congress. "--Star Tribune (brought to you by the folks at Alvista foreign investor front group)

This is how it is a win for Franken.

While Eric's proposition seems like a possibility, it leaves me thinking that if anything would give the US Senate a politically safe excuse to refuse to seat Coleman it would be his use of such a tactic.

So how is this a win for Franken? It sounds like all Coleman's campaign has to do is not agree to any of the wrongly rejected ballots, and none count. We can only hope the counting of the challenged ballots leaves Franken ahead, so the wrongly rejected ballots are Coleman's only hope. Otherwise, he is sure to block them.
