Campaign contributors and volunteers for former Minneapolis city council candidate Charles Carlson are sending letters to Hennepin County Attorney Mike Freeman urging him to investigate Carlson, former campaign workers said Wednesday.
Carlson abruptly dropped his campaign to represent Minneapolis’ 2nd Ward Sunday when reporters for the Minnesota Daily discovered he had fabricated important details about his life and provided the media with false documents about his educational background.
“Carlson’s deceptions were not merely unethical and wrong. They also likely were illegal,” said Jesse Berglund, who had volunteered for the campaign.
“Carlson used his deceptions to obtain campaign contributions from many people, who likely donated in reliance on the truth of his statements. This is theft through fraud, and everyone who donated to his campaign should be able to seek restitution for the amount they donated.”
Carlson told the Daily that the falsehoods he provided were the products of mental illness. Berglund said that that may be the case, but his interactions with Carlson did not indicate someone who could not make rational decisions.
“While I have the deepest sympathy for Charles and his history of mental illness, he did not appear of unsound mind at any time during my personal interactions with him,” he said.
Berglund sent out a message on Carlson’s Facebook campaign group Wednesday evening alerting supporters that he was asking for an investigation, and within hours the group disappeared, he said.
Carlson has not communicated with his supporters since Sunday, when the former candidate said he was suspending his campaign to officiate tennis matches. Many have been left wondering if their contributions will be returned.
“Many former supporters expressed to me their anger, frustration, and disbelief at what happened,” said Berglund. “As he suspended his campaign, he still could not apologize to his supporters, instead claiming that he ended the campaign so that he could officiate tennis elsewhere.”
Kyle Archer, who also volunteered for the campaign, said, “I think what bothers me the most about it, is that I helped him, unknowingly, cheat people out of thousands of dollars, and now I have to live with that. He had us all fooled.”

It seems lots of candidates have done something actually illegal, more than making up a personal story, but they weren’t subject to fraud charges for contributions given after they swore the allegations amounted to nothing. By this reasoning, every politician forced to resign from office or drop out of campaign will be subject to criminal charges for campaign contributions. Maybe some people think that should be the case, but do understand that’s where this leads. And where would the line be drawn? If a candidate denied the bribery allegations and then admitted them, would his contributions then be fraud? How about if a candidate made inflammatory statements and told supporters he hadn’t made them, nothing illegal just controversial, would that be fraud?
I’m not suggesting Charles Carlson should get to maintain a campaign fund. I don’t know the legal options, but he can’t keep it. Neither however is taking them in the first place criminal if he didn’t break a specific campaign finance law.

I believe the law Mr. Berglund is referring to is MN Stat. 309.55, Subd. 5 which states:
“No charitable organization and no person acting on behalf of a charitable organization shall use or employ any fraud, false pretense, false promise, misrepresentation, misleading statement, misleading name, mark or identification, or deceptive practice, method or device, with the intent that others should rely thereon in connection with any charitable solicitation, including any such actions or omissions designed to confuse or mislead a person to believe that such organization is another organization having the same or like purposes; or to believe that the funds being solicited are or will be used for purposes and programs conducted within or for persons located within the state of Minnesota when such is not the case; or to otherwise present purposes and uses of the funds which are not as provided within the purposes and uses filed upon registration of said organization under this chapter, or if no such registration has been filed, then as provided under the exemption of said organization from federal and state income taxes as an organization formed and operating for charitable purposes as defined herein.”
However, this statute correlates with charitable organizations, Section 501c(3) organizations. A political fund is not considered a charitable organization by any means. It is actually a Section 527 organization.
To explain, when people get on TV and claim that Barack Obama is a muslim terrorist cocaine dealer, and people donate money to that organization, it is entirely legal. So while Carlson was ethically wrong, mentally ill, whatever, he did not break any laws.

Maybe we should investigate barak obama with such enthusiasm. I feel there is more to the Charles Carlson story than meets the eye. I would not put it past the Democratic Party to be running a smear campaign behind the scene. They ceased to be my Party after this last election year.

“Esmeralda” = Charles Carlson.
He has a history of comment on articles about him that put in a negative light.

I first met Mr. Carlson at a GLBT event last year and instantly knew he was a fraud–there was something just not quite right.
Yet he weasled his way into the “A-List” of the Twin Cities gay community and everyone fawned over him. Maybe it was the accent.

This is just getting laughable. Charles, just stop already. Please. Just stop commenting on articles and go seek help or something already. You are obsessed with defending yourself, when really, you should be apologizing and giving people their money back.
Quit lavishing yourself with praise, quit bringing up Obama disparagingly in your comments (he is more of a man than you will ever be), quit manufacturing outrage against those who exposed you (the only outrage is from those you’ve manipulated) and for the love of God, quit calling this a smear campaign. People are doing nothing but telling the truth, which, to anyone of at least sound mind, does not equate to smearing.
It seems you’ve learned nothing, which is quite sad. You are just setting yourself up for more failure.

What I meant about this being a smear campaign is that in my view, it truly is – Why so much fuss over a candidate for City Council? Even if some or all of this is true about Charles, why so much publicity over it? From what I’ve read, he raised $1700! That can’t have impacted that many donors and from what Charles has said, he is doing everything he can to get money back to those who have asked for it which, by the way, I think is ludicrous. Many candidates have had to drop out of campaigns for various reasons and have not had to give money back to donors and there have been many who have lied in worse ways than this.
I also assure you that I am of sound mind and believe it or not, there are others whose opinions differ from yours. I just happen to have compassion for Charles especially if he is suffering from some kind of mental illness. I don’t know what your deal is with Charles. Maybe I should assume that “LaTaya=Adam” because you both happen to have that view of Charles. I’m giving you the benefit of the doubt. Rest assured that “jka DOES NOT =Charles” and neither does Esmeralda. We are real people who know Charles and even if he’s made some mistakes, it doesnt alter our opinion of him.
I recommend trying a little compassion. It truly is life altering when you view others from a compassionate point of view instead of a judgmental point!
As I said to LaTaya, whatever your deal is with Charles, get over it and move on!

I agree with Justin and had similar contact with Charles. He made such a big deal about his elite education, I knew he was full of it. No one needs to talk about theircollege prepatory education so much. I called my Exeter friends that actually graduated the same year he claimed to have graduated — none of them heard of the guy. His tall tales seemed to accumulate by a magnitude. I’d love to hear more from donors as to why they didn’t suspect a fraud sooner.

My brother met Charles through friends of his. My brother is very innocent, and believed EVERY word that Charles said to him. Charles even became angry with him, and posing as a Brit, said some very nasty and inhumane things about the Irish people. When I spoke with my brother last, he said something seemed a-miss with Charles. My brother, has always been kind to Charles, and has not taken to opportunity to return any ill feelings. I just recently showed him these articles I found, and his response was, “that’s too bad, he seems like such a nice guy…” Even after Charles called our family terrorists and war criminals. Charles is a liar and manipulative. I am sorry so many people suffered abuse at his hand, and pray that he received just punishment.
