That is the beauty of Bush's Global War On Terror. The forever war.

Bush's authorizing Torture changed everything. Now the evidence for trials is tainted, so Obama's options are more limited. Can't prosecute them, can't release them, won't call them POWs. What to do?

Torture put Obama in this fix. If Bush's lawyers had not twisted the Federal Anti-Torture Laws so Bush and Cheney could Torture, we wouldn't be in this fix.

One solution is to prosecute those that ordered Torture or conspired to Torture and did so in our name. Torture needs to once again become the heinous, unthinkable, undebatable Federal crime Reagan signed into law.

In a way I don't know why this is so difficult. POW status is made for prisoners who are hostile and can't be safely released, but aren't criminals.

It's a problem for people who want the power to imprison anyone indefinitely with no accountability since POWs are protected from interrogation, can't be subjected to criminal trials, have a right to inspections by the International Red Cross, and have to be released when the war is over. On the other hand, it seems perfect for prisoners who can't be tried because the evidence is tainted, but are considered dangerous. This seems exactly the solution for Obama's "third category" of prisoners.

So I don't understand why POW status isn't being considered.
