One solution is to prosecute those that ordered Torture or conspired to Torture and did so in our name. POW status is made for prisoners who are hostile and can't be safely released, but aren't criminals. It's a problem for people who want the power to imprison anyone indefinitely with no accountability since POWs are protected from interrogation, can't be subjected to criminal trials, have a right to inspections by the International Red Cross, and have to be released when the war is over. On the other hand, it seems perfect for prisoners who can't be tried because the evidence is tainted, but are considered dangerous. This seems exactly the solution for Obama's "third category" of prisoners. So I don't understand why POW status isn't being considered. In a way I don’t know why this is so difficult.
