Rep. Michele Bachmann took some heat on Tuesday for using the logo for the Minnesota State Fair in a television ad targeting DFL opponent Tarryl Clark. The campaign said late Tuesday afternoon that it was dropping the state fair logo from the ad.

“Earlier today Bachmann for Congress released a television advertisement coinciding with the Minnesota State Fair,” the campaign said in a statement. “While our attorneys advise us we have a legal right to use the State Fair logo, Bachmann for Congress has decided to swap it for a more generic icon.”

Officials for the Minnesota State Fair had asked the campaign to remove the logo.

So millions of tv viewers got to see her illegally use the State Fair ad and her campaign doesn’t even get a slap on the wrist? So any candidate can use whatever logo they want in a big tv advertisement and as long as they eventually remove it when called on their misuse, they pay no penalties whatsoever?

Check her Ipod. If she sez she can rip off the State Fair then she probably owes Amy Grant money.

Businesses never admit to wrongdoing either.

Credibility and trust are out the window, but salesmen still manage to sell the product.

Why isn’t she being penalized? Good God, if she doesn’t get hit with a significant penalty, she’s just going to keep doing this crap. She should have to pay for ads which point out her improper use of the logo. Hypocrit!

I really want to know how her lawyer came to the conclusion that she can use the logo in the first place.
Or did he get his law degree from the university of google?

From the website:

“The fair use and nominative use defenses are to help ensure that trademark owners do not prohibit the use of their marks when they are used for the purpose of description or identification.”
