The “Draft Bob Fletcher for MN Governor in 2010″ Facebook page currently has 334 friends. The “DraftFletcher” Twitter feed has attracted 44 followers.

But unlike recent campaigns to entice R.T. Rybak and John Choi into political contests, the sincerity of the effort to woo Ramsey County’s top cop seems a bit questionable.

The most recent tweet, for instance, declares Fletcher “the only candidate who is honest about their corruption!” The Facebook page lists his title at the Ramsey County Sheriff’s office as “supreme leader.” Then there are the pictures of the young woman being blasted in the face with pepper spray by a cop during last year’s Republican National Convention.

Not exactly the image most politicians seek to convey.

It’s unclear who’s behind the mock campaign. An email to the Facebook account received no immediate response.

But Fletcher earned the enduring enmity of protesters for his department’s heavy-handed tactics leading up to the Republican National Convention. More recently he’s been criticized for failing to provide proper oversight of the beleaguered (and now defunct) Metro Gang Strike Force.

“This is an exciting first step in this campaign,” Bostrom said in a statement announcing the formation of the “Bostrom for Sheriff” committee. “I am confident that my commitment to professional public service and to the core values of protecting our citizens, partnering with the community, reducing neighborhood crime, practicing fiscal responsibility, and collaborating with other law enforcement agencies are what the citizens expect from their sheriff.”

Bostrom is the son of veteran St. Paul City Council member Dan Bostrom, but is best known for heading up security efforts during last year’s Republican National Convention. Fletcher was critical of security preparations for the national gathering, repeatedly warning that the St. Paul department had failed to recruit enough police officers to ensure that it went off without serious problems.

Fletcher is a polarizing figure. The sheriff’s department drew the ire of social-justice activists last year by infiltrating the (ironically named) RNC Welcoming Committee. A series of police raids in the days leading up to the convention eventually resulted in criminal charges against eight activists who were allegedly plotting to damage property and disrupt the Republican gathering.

The four-term incumbent’s also been at the center of an investigation into the activities of the beleaguered — and now disbanded — Metro Gang Strike Force. Two damning reports released earlier this year alleged that the law enforcement agency routinely seized money from citizens without justification, failed to adequately keep track of its assets and displayed a general disregard for the civil rights of citizens, particularly minorities. The Ramsey County Sheriff’s Department was the fiscal agent for the gang strike force.

In 2006, former St. Paul Police Chief William Finney took on Fletcher in a bruising political contest, but the incumbent ultimately prevailed by just over 1,000 votes.

In recent weeks supporters of the so-called RNC Eight, accused of conspiring to violently disrupt September’s Republican National Convention in St. Paul, have ratcheted up their campaign to have criminal charges against the activists dismissed. The Duluth Central Labor Body, with 17,000 members, passed a resolution condemning the prosecutions. A petition signed by roughly 3,000 people was delivered to Ramsey County Attorney Susan Gaertner’s office by serenading protesters. And one of the RNC Eight defendants made an appearance on MSNBC earlier this week.

The high-profile nature of the prosecutions, coupled with Gaertner’s ongoing campaign for governor, means that today’s decision to drop the most inflammatory terrorism charges against the defendants was certain to be viewed through a political prism.

“It’s becoming a real national issue of controversy that obviously is embarrassing for somebody who’s running for governor,” says Jordan Kushner, an attorney for one of the defendants. “I don’t think she’s going to get out of it just by dropping those charges, as far as the political implications go.”

Bruce Nestor, another of the defense attorneys, is slightly less cynical in assessing Gaertner’s motivations.

“I think this is a political case,” he says. “It doesn’t have to be about her own personal ambitions. … If this had proceeded as a typical anonymous prosecution, our clients would still be facing terrorism charges.”

Gaertner disputes that her political ambitions — or any factors beyond the merits of the case — played a role in her office’s deliberations.

“This case, like many the county attorney deals with, is a no-win situation politically,” she says. “In this case, as in so many, some people will think I’m too harsh; some people will think I’m too soft. I have to put aside the background noise and make decisions based on how I can achieve justice and public safety. That’s what this decision was based on.”

The news that the terrorism charges would be dropped, first reported this morning by Minnesota Independent, is being cheered by the group’s supporters. But the defendants — Erik Oseland, Eryn Trimmer, Garrett Fitzgerald, Luce Guillen-Givens, Max Specktor, Monica Bicking, Rob Czernick and Nathanael Secor — still face felony counts of conspiracy to riot and damage property, punishable by up to five years in prison. Nothing in the criminal complaints, which detail a purported criminal conspiracy to sow chaos at the Republican National Convention, has changed. The next hearings in the cases are slated to take place in May.

According to Gaertner, the dropping of terrorism charges was a routine decision the likes of which her office makes on a daily basis. “We amend complaints as a part of trial strategy frequently,” she says. “As you get ready for trial, you get a better sense of what you think the core is of your case, what you think the jury is going to respond to and you proceed accordingly. That’s exactly what happened here.”

Gaertner further insists that the decision is not an acknowledgment that the prosecution lacked sufficient evidence to secure convictions.

“We cannot proceed on a case unless we believe as prosecutors that we have sufficient evidence to convict the defendants as charged beyond a reasonable doubt,” she says. “That’s true in every case; that’s true in this case. The terrorism charge enhancement wasn’t dropped for evidentiary reasons. It was dropped for trial strategy reasons.”

But defense attorneys for the RNC Eight say it’s an admission that the prosecution didn’t have a credible case. “The reality is that they recognized that it was a charge that couldn’t be sold to a jury, and it hadn’t been sold to the public,” says Nestor. “While we welcome it, it doesn’t change what’s wrong at the core of the investigation and the prosecution, which is that the investigation and the public statements about it to date have proceeded as if these eight organizers are terrorists.”

Ramsey County Sheriff Bob Fletcher, whose office played a central role in the criminal investigations that lead to the RNC Eight prosecutions, is supportive of the county attorney’s decision. “This will eliminate one element of the crimes that needs to be proved at trial and will make it easier to convict the defendants on the charges of riot and criminal damage to property,” he says. “The terrorism charge would have been a distraction at trial and further confused the journey.”

The RNC Eight were thought to be the first defendants indicted under what’s been billed as the Minnesota version of the federal PATRIOT act, which provides for enhanced penalties in terrorism cases. Gaertner says her office was simply following the law in bringing the prosecutions.

“This law, as written, was passed in the post-9/11 atmosphere of fear,” she says. “I don’t know what the Legislature intended when they wrote the law the way they did. But if they didn’t intend it for cases like this, they should amend it.”

The video, taken by Twin Cities Indymedia, documents tour stops with cops-on-bikes in tow, a luncheon at a Minneapolis church with a parking lot full of police vehicles, and a musical (but “awkward”) petition-presentation to Ramsey County District Attorney Susan Gaertner with someone the TC Indymedia identifies as a plainclothes officer making his own video recording.

The events were in support of the RNC8, the eight individuals who face felony terrorism conspiracy charges from arrests made at pre-emptive raids before the RNC took place. Friends of the RNC8 are asking Gaertner to drop the charges.

In the video, famed FBI whistleblower Coleen Rowley presents Gaertner with an appeal from famed Pentagon whistleblower Daniel Ellsberg, among others. Don Olson, a member of the Minnesota 8, a group who vandalized a Vietnam War-era draft office, told Gaertner, “We actually did something, but they didn’t do anything.”

TC Indymedia said 50 riders (not “rioters,” as it sounds like on the video) took part in the Tour de Fletcher, named for Ramsey County Sheriff Bob Fletcher, the man behind much of the law enforcement at the RNC.

After estimating the post-luncheon contingent at seven or eight remaining bicycles, a St. Paul police officer is shown issuing a radio message: “They’re not very forthcoming on information so I guess they don’t want to be safe on their bicycle ride.”

Police made one arrest for disorderly conduct, according to the video.

In a letter to Minneapolis Police Chief Tim Dolan, bike-tour participant Nigel Parry wrote:

You are making the Cities a scary place to live. We should be able to go about our Constitutionally-guaranteed business, our political associations, and our vegan potlucks without this kind of—frankly—pervasive and fascist intervention.

The RNC Eight, accused of a criminal conspiracy to wreak chaos during the Republican National Convention, are unlikely to go on trial for at least another six months. But the battle to shape public opinion on the high-profile case has been taking place since the moment of their arrests on the eve of the St. Paul convention in early September.

At a hearing Tuesday afternoon before Ramsey County District Court Judge Teresa Warner, attorneys for the prosecution and defense traded charges over which side had stepped over the line in attempting to manipulate media coverage. Previously Judge Salvador Rosas, who is no longer hearing the case, had warned both sides to be cautious in their public relations machinations.

The prosecution is now seeking an order barring the defense from leaking nonpublic evidence to the media. As evidence of the need for such a prohibition, Assistant County Attorney Heidi Westby cited a Star Tribune article from Dec. 1 based on the review of 1,000 pages of documents provided by a source. The reports detailed the infiltration of the RNC Welcoming Committee by undercover deputies from the Ramsey County Sheriff’s Office.

Westby stated that attorneys for the eight defendants were the only ones with access to the documents. She further argued that the evidence includes private individual information, such as juvenile arrest records and financial data.

“They had not been disclosed to anyone else,” she said of the evidence. “This case should not be tried in the press.”

But attorneys for the two defendants in court today — Max Specktor and Monica Bicking — countered that Ramsey County officials are the ones guilty of trying to game the legal process through media manipulation. They noted that Ramsey County Sheriff Bob Fletcher and County Attorney Susan Gaertner have held press conferences and released evidence unavailable to defense attorneys.

Attorney Larry Leventhal, who represents Specktor, accused the prosecution of seeking to control media coverage by muzzling the defense. “I think she’s being exceedingly disingenuous,” Leventhal said of Westby. “They are attempting to monopolize the conversation.”

Attorney Bruce Nestor, who represents Bicking, said that the prosecution has consistently utilized evidence unavailable to the defense — including ballistics tests and lab reports — to tar their clients in the media. “For months my clients have been attacked in the press,” he said. “There was a purpose to that, and it’s to prejudice my clients to the public.”

Judge Warner did not rule on the matter. Similar preliminary hearings will be held for the remaining defendants — Erik Oseland, Eryn Trimmer, Garrett Fitzgerald, Luce Guillen-Givens, Nathanael Secor and Rob Czernik — over the next week. The cases are currently expected to go to trial in September. Only about 15 percent of the more than 700 people arrested during the RNC have been charged with crimes.

At the close of Tuesday’s hearing, Warner counseled both sides not to engage in behavior that will taint the case. “I won’t tolerate any games being played, any shenanigans,” she said. “We’ll try this case in the courtroom on the evidence that’s presented.”

FBI whistleblower-turned-activist Coleen Rowley is on a roll. She ripped into the City of St. Paul’s report on Republican National Convention law enforcement in a commentary that appeared Friday at MinnPost and today at The Huffington Post. Tomorrow, as court hearings start in the cases of the RNC8 protesters, Rowley and individuals from Women Against Military Madness (WAMM) and other groups will file formal complaints against the city, state and Ramsey County over police tactics. And Rowley’s inquiries into what she suspects was overbroad surveillance during the RNC are starting to bear fruit — or at least what she calls a first “non-responsive” response from Ramsey County Sheriff Bob Fletcher’s office.

In her commentary, Rowley cites President Obama’s inauguration as an example of a National Special Security Event (like the RNC) that police pulled off “somehow, without tear gas, tasers or thousands of people dragged off in handcuffs.” St. Paul’s Heffelfinger-Luger report, Rowley points out, avoids the question of “whether such aggressive ‘police state’ action during the RNC was actually necessary.” She concludes:

Perhaps the worst mistake made in the RNC Commission Report is falling for the notion of trade-offs between security and liberty instead of seeing them as intertwined. President Obama phrased it well in his inaugural speech statement, when he said “we reject as false the choice between our safety and our ideals.”

After a “Mardi Gras-themed procession” at noon on Tuesday on the state Capitol lawn, Rowley and others plan to file ”Notices of Claim” (pdf) that will contain charges like this:

In the year-long investigation and planning that preceded the RNC and the police enforcement during the RNC, Sept 1-4, 2008, the Ramsey County Sheriff’s Office, along with other state, local and federal law enforcement agencies and private corporations and associations of private companies, including the “Department of Homeland Security’s (now defunct) Highway Watch” and presumably the FBI’s “InfraGard” corporate partnerships did produce faulty and defamatory “intelligence” assertions that linked the organization WAMM that I am a member of to “terror networks”. Ramsey County opened an investigation approximately one year before the RNC that provided the basis of the false claims used to defame WAMM and to violate the privacy rights of WAMM members by then disseminating this information to private corporations, associations and other law enforcement agencies.

Rowley’s public-data requests to the FBI (her former employer) and Ramsey County have so far elicited only a brush-off response from Fletcher’s office (pdf).

Her draft response:

1) If I understand correctly, any data gathered on the other organizations and groups (besides the RNC Welcoming Committee) that I inquired about—to include that gained by viewing their websites–is not contained in separate files but in the same investigative file as the one that has led to prosecution of some of the “RNC Welcoming Committee”. Is that understanding correct?

2) If you are saying that the information your Department has collected on other groups and members of other groups, is all contained in one big file, there still would be no reason it cannot be segregated out for release, would there? Since there are no ongoing prosecutions related to these other groups and members of these other groups? For example: the “Women Against Military Madness (WAMM)”; “Troops Out Now”; the “Anti-War Committee”; “Protest RNC 2008” and other peace and social justice groups are charted out in a “Social Network Analysis” and “Power Centrality Ranking” that links them to the “RNC Welcoming Committee” in a Homeland Security-Highway Watch document that has recently come to light. It’s not clear whether this “intelligence” product was only produced as a result of “viewing their websites” but even if that’s so, wouldn’t there at least be notes and copies made from that law enforcement effort of analyzing the public websites?

3) I have a hard time believing that Ramsey County Sheriff Department informant(s) reported information only on the “RNC-8”. It is precisely the other individuals who are not being prosecuted and about whom information may be contained in the Ramsey County Sheriff’s Office that is of interest for the research that Mr. Cox and I are conducting. Are informant report files maintained separately?

4) Again assuming I’m correct in believing that the Ramsey Sheriff Department’s information is contained in one big file that also involves the information collected on the “RNC Welcoming Committee,” what is the name of that file? How is it indexed for retrieval and further use? Was the file opened to contain all investigative data collected in the lead-up to the RNC or was it focused solely on the RNC Welcoming Committee? If the latter, why would the information on other groups and members of groups not connected to the prosecution of the “RNC Welcoming Committee” not be releasable at this time? Can you give me an idea of the size of the file and how many other individuals and groups (not being prosecuted) are documented or referenced in the file?

5) Why did you ask for a delay when first responding to my request back in December, telling me you expected my request to take a lot of time to gather up responsive materials?
