			<content:encoded><![CDATA[<p>The Minnesota Independent liveblogged and tweeted (at <a href="http://twitter.com/MnIndyLIVE">MnIndyLIVE</a>) the Nov. 26 State Canvassing Board meeting, at which Minnesota Secretary of State Mark Ritchie led the five-person board in considering the Al Franken for Senate campaign&#8217;s <a href="http://minnesotaindependent.com/18578/us-senate-recount-back-to-the-battle-over-rejected-absentee-ballots" target="_blank">request</a> that they find a way to count votes from all improperly rejected absentee ballots.</p>
<p><strong>9:30:</strong> Despite all eyes being on Minnesota&#8217;s recount, the room is only half filled. The five members of the canvassing board have taken their seats. Secretary of State Mark Ritchie calls the meeting to order.</p>
<p><strong>9:34: </strong>Other recount results are announced: Lisa Fobbe (SD 16), Al Doty (HD12B) and Gail Kulick Jackson (HD 16A), all Democrats, have officially won their races.</p>
<p><strong>9:36: </strong>Now the discussion turns to challenged ballots: both campaigns believe the number of contested ballots can be decreased.</p>
<p><strong>9:37:</strong> An election official in Sherburne County reports 800 challenges, with roughly 15,000 ballots left to count.</p>
<p><strong>9:42: </strong>Mark Ritchie says more than 12,000 absentee ballots were rejected. He adds that the Attorney General has not weighed in on the canvassing board dealing with such issues; some have challenged the appropriateness of the board addressing rejected absentee ballots.</p>
<p><strong>9:46: </strong>G. Barry Anderson moves that the board NOT review rejected ballots: <span class="entry-content">&#8220;There are no historical examples of a canvassing board actually including rejected absentee ballots.&#8221;</span></p>
<p><strong>9:47:</strong> Edward Cleary disagrees; he&#8217;s &#8220;not persueded by case law we&#8217;ve been provided.&#8221;</p>
<p><strong>9:57: </strong>Gearin says it would be absurd not to count. Local election judges should review whether they have ballots that were not rejected but also not counted. But she doesn&#8217;t want this board to evaluate them. She&#8217;s the third vote against the Franken proposal, so it&#8217;s dead.</p>
<p><strong>10:00:</strong> Ritchie: Should all rejected absentee ballots go to court? No support here for opening ballots. But there is support here for examining how they&#8217;re handled. Anderson signals some openness to addressing the problem in another way. Ritchie answers Gearin&#8217;s concern that law and procedures already provide for finding uncounted absentee ballots.</p>
<p><strong>10:05:</strong> Chief Justice Eric Magnuson speaks for the first time. Rejected ballots are not cast ballots, and cast ballots are what this board is supposed to deal with. Cites historic cases in the Supreme Court that say judicial, not ministerial, officers (such as the canvas board) should decide such things.</p>
<p><strong>10:10</strong>: Magnuson: &#8220;We&#8217;re not going to lose any ballots. They&#8217;re all going to be kept safe.&#8221; Cleary asserts that statutes have expanded the board&#8217;s powers since the 1800s cases Magnuson cites. Cleary: People vote absentee out of necessity (sometimes). Their votes need to be taken as seriously. Ritchie friendly amendment: intent to count illegally rejected absentee ballots. Cleary clarified re: fifth pile of improperly rejected ballots is not out of our purview. Unanimous approval of motion.</p>
<p><strong>10:15:</strong> Magnuson asks Ritchie can&#8217;t he do this without the canvas board taking action. Sorting the ballots into five piles at the local level: &#8220;It&#8217;s asking a lot of people of whom a lot has already been asked of.&#8221; Magnuson on a question that arose in the 1962 Minnesota governor recount (Anderson v. Rolvaag). Could canvas board accept amended returns from county canvas boards? Ritchie doesn&#8217;t know. Could get attorney advice. Anderson: &#8220;Once we get into the woods of opening ballots &#8230; &#8221; He&#8217;s reluctant to get into that area without advice from the attorney general. Cleary says there are only four grounds to reject, so any ballot that doesn&#8217;t fit in those four categories should be subject to opening (if it&#8217;s an absentee ballot in an outer envelope).</p>
<p><strong>10:20</strong>: Ritchie suggests that the so-called fifth pile of uncounted absentee ballots should return to this board. Asks for opinions. Gearin: It&#8217;s either in those four categories and rejected or in the fifth pile and should be counted. Magnuson: &#8220;At some point in the process you&#8217;ve got to stop counting. &#8230; At some point in time the count is certified and it&#8217;s done. Are we at a point in time when if additional ballots are found, could they be counted? Or are we beyond that?&#8221; Ritchie: Not beyond it until we&#8217;ve signed off. Magnuson: We don&#8217;t have authority to tell local election judge how to rule. That kind of dispute has to be taken up in an election contest (i.e. a lawsuit). Cleary: Respectfully disagree with Magnuson and agree with Gearin: must count fifth-pile ballots. Anderson: Needs attorney general opinion. Ritchie: &#8220;Typically they say we&#8217;ll get back to you on that.&#8221; Ritchie: &#8220;There&#8217;s a whole &#8216;nother problem here and that is keeping the cooperation of the people [who are doing the recount].&#8221; Staffer points to correction of errors when both sides agree in statutes. </p>
<p><strong>10:25</strong>: Cleary says candidates can still challenge the ballots inside the absentee envelope. [I have a question: Aren't local election officials supposed to mail back rejected absentee ballots to voters? The state or counties don't have those ballots anymore, except for a photocopy of the envelope at most.] Gearin: &#8220;If it&#8217;s in the fifth pile, it should be opened and counted.&#8221; Ritchie: More to say? Cleary: What about my motion? Anderson: Make motion now or wait for advice from counsel? Ritchie: &#8220;I hear a general agreement with moving ahead with sorting. This is a very important next step for all of us. &#8230; There are other forces at play here: candidates&#8217; counsels, citizen groups.&#8221; Magnuson: &#8220;it would be unwise for us to make a decision right now without hearing from the attorney general&#8217;s office.&#8221;</p>
<p><strong>10:30</strong>: Gearin: Commends the local election people. &#8220;We should be proud of them, and proud of our state.&#8221; Approved by acclamation. </p>

Check it out after the jump.<span id="more-13076"></span>12:00 noon: I&#8217;m running late but I&#8217;ll check in as soon as I&#8217;m in the hall. Here&#8217;s what I missed, as recorded on the Humphrey Institute&#8217;s <a href="http://blog.lib.umn.edu/cspg/smartpolitics/2008/10/live_blog_erik_paulsen_gop_3rd.php">Smart Politics liveblog</a>: </p>
<blockquote><p><strong><span style="font-weight: normal;">12:05 p.m. </span></strong>Paulsen says his reason for running for the 3rd District is that Congress is &#8216;broken.&#8217; Paulsen also says he has learned civility from retiring Representative Jim Ramstad, for whom he once worked in D.C. Ramstad and Paulsen have criticized the Ashwin Madia campaign for its &#8216;gutter tactics&#8217; in this race.</p>
<p><strong><span style="font-weight: normal;">12:13 p.m. </span></strong>Paulsen says he was not a fan of the stimulus check that was sent out earlier this summer. He is opposed to these &#8216;short-term solutions&#8217; and the country needs real economic incentives by making changes to the tax code, and making these changes permanent (he wants to make permanent the Bush tax cuts).</p></blockquote>
<p>12:20 p.m.: Been here five minutes and already lost a liveblog post to the U of M&#8217;s wifi system. I&#8217;ll try to catch up. Paulsen is speaking, has referenced Sweden as lowering corporate tax rates and China (where <a href="http://gavinsullivan.blogspot.com/2008/10/paulsens-internationalist-bullshit.html">Paulsen has visited</a>) as a country where Schwan&#8217;s ice cream could sell its products to a billion Chinese.</p>
<p>12:25 p.m.: China, Japan, India, Sweden &#8212; he&#8217;s really touring the world with this speech. China has 1.2 billion people, will soon be the top English-speaking country in the world, will quadruple higher ed enrollment in next decade.</p>
<p>12:30 p.m.: Prof. Larry Jacobs asks crowd (of about 40, half of yesterday&#8217;s Madia event) to write questions on cards. Jacobs asks about what to do at the current moment in the financial crisis, if you&#8217;re fiscally conservative. Paulsen: As Republican, I&#8217;ve been frustrated with party members for not exerting fiscal discipline &#8212; a bipartisan spending spree. And that goes for Bush administration as well. It&#8217;s about living within your means, which is hard for legislators &#8212; to say no. Proposes sunsets for funding legislation. </p>
<p>12:35 p.m.: (Another point where Paulsen echoes recent sounds from Madia camp: simplifying tax forms, a move U.S. Rep. Rahm Emanuel endorsed while in town to stump for Madia.)  Fiscal responsibility, as he grew up as a good German Lutheran, means to conserve. Jacobs: Would you have voted for second bailout plan that passed. Paulsen: Reluctantly yes. Bill had improved with FDIC insurance limits fix, pricing corrections. But what&#8217;s going to happen next? Wants to make sure taxpayers see an upside with repayment in the future.  </p>
<p>12:40 p.m.: Paulsen makes two metaphors that might be seen as unfortunate, to Iraq and New Orleans. What is our economic exit strategy? He&#8217;s concerned that financial sector is moving from new York to Washington, D.C. Then he cites Hurricane Katrina (ouch!) as evidence D.C. can’t do stuff right. Paulsen gives example of the farm bill as one in which Republicans went along with legislation that isn&#8217;t financially sound. It&#8217;s wrong, and thinks his constituents don&#8217;t really support it. He supports agriculture, but not to the tune of subsidizing millionaire farmers. Pharmaceutical industry policy has been helpful, a good thing, although there&#8217;s still too much chaos or choice. Jacobs comes back to the cost side of it: Would Paulsen have voted for the program? Paulsen: Yes. (Notion of the government not being allowed to strike best deal with pharmaceutical companies isn&#8217;t raised by either Jacobs or Paulsen, although Jacobs seemed to be driving at that.</p>
<p>12:45 p.m.: Paulsen: Regular commercial banking industry is probably over-regulated. Jacobs: Clarifies that Paulsen wants regulation for unregulated areas of financial sector. Paulsen agrees. Jacobs: What about regulating credit card companies? Paulsen: I&#8217;m not a fan of regulation and wary of overstepping proper bounds. Jacobs: A new agency is being proposed to regulate consumer credit. Paulsen: To push home ownership towards folks for whom its unsuitable &#8212; there needs to be regulation of that. For me it doesn&#8217;t make sense that people would expect to buy a home with no money down and expect someone to buy their mortgage as part of a package. Jacobs: But would you be in favor of expanding regulation in subprime mortgage area? Paulsen: Absolutely. jacobs: Asks re: AIG, insurance industry. Paulsen cites states&#8217; role in regulating insurance. So-called &#8220;too big to fail&#8221; companies like AIG &#8230; there didn&#8217;t seem to be a consistent standard on that from the Bush administration. </p>
<p>12:50 p.m.: Jacobs: Conservatives seem confused about where nationalization of banks stops. Paulsen: i am suspicious of that. We seem to be in uncharted waters. Good to see G20 come up with a plan. Whether you&#8217;re conservative or liberal, question is what is the appropriate role for governement. Jacobs: So you would take into account functioning of markets in determining whether government should be involved. Some people seem contagion as different industries (airlines, health care) ask for help. Would you take these on case-by-case basis or is there an overall appropriate answer? Paulsen: Review each situation on its own, not ideologically.</p>

<p class="MsoNormal">1:00 p.m.: Jacobs: Obama is president,<span> </span>let’s say. Support line item veto? Paulsen: Yes, no matter which party has presidency. It’s a good tool for eliminating pork. Jacobs: how do you propose to control rising cost of education for middle class? Paulsen: References his four daughters, and the cost of their weddings (joke) let alone education. Debt load for students is so heavy it could be next subprime mortgage crisis if job market can’t support them on graduation. Solution is financial aid, such as Pell grants and the state’s program.<span> </span>Jacobs; Regulate tuition hikes? Paulsen: I’d look at it. Is it over-regulation? The top-down model presents false choices between<span> </span>spending options. Jacobs: How do you increase the number of engineers, for example. Paulsen: Require higher math at younger age, although I’m resistant to idea of federal government doing more that asking states to set goals.<span> </span>Paulsen cites Chinese who get up a 6 a.m. to study. Jacobs: Support free trade? Paulsen: Yes. It was a travesty that Columbian free trade was sidelined by Congress.<span> </span>Special interests and unions got hold of that one.</p>
<p class="MsoNormal"><span>1:10 p.m. Jacobs: Free trade losers raises question of what to do about those on the downside who are anxious or losing jobs? Would you support job programs? Paulsen: We’re always going to have workforce resources for retraining. Cites his trip to India to bring up retirement-like accounts that individuals and employers can contribute to for individual lifelong learning savings.</span></p>
<p>1:15 p.m.: Very small crowd is hanging out in animated conversation in the hall. A couple student reporters are interviewing others in the audience as the event breaks up. I&#8217;m going to repair to a table in the lobby where the wifi signal is better and try to reconstruct this liveblog from various peices that may be floating in cyberspace.</p>
<p>1:30 p.m.: Interesting example of market forces at work at the reception afterwards. There seems to be more pizza today than yesterday, perhaps in response to not having enough yesterday. But today there are fewer people to feed, so the extra pies reflect a basic difficulties in supply meeting anticipated demand. Perhaps government could step in at least temporarily to regulate pizza distribution for campus events &#8212; but if so they must act soon, because Independence Party candidate David Dillon will be here at noon on Friday for his turn to be grilled by Jacobs and student questioners. Will Dillon draw people who attended Madia&#8217;s event, or Paulsen&#8217;s? As in politics, the third party presents a catering conundrum:</p>

So to wrap up, how did people do?
<p>
Giuliani: F.&nbsp; He sounded good at times, but if I was a pro-life Republican, I&#8217;d be pretty disgusted by him right now.&nbsp; His abortion policy is not pro-choice&#8211;it&#8217;s completely incoherent.&nbsp; And if anything, he managed to muddy the waters more.
<p>
McCain: C-minus.&nbsp; Through much of the debate he seemed lost.&nbsp; He sounds old, and he sounds worn out.
<p>
Romney: B.&nbsp; Generally sounded and looked the most superficially presidential.
<p>
Brownback: C-plus.&nbsp; Certainly didn&#8217;t inspire enough confidence to vault to the upper tier.
<p>
Tancredo: B.&nbsp; Oh, he sounded crazy, but he&#8217;s really just running for the elimination of Mexicans, and he did a good job of pounding that theme.
<p>
Hunter: B.&nbsp; Looks oddly like a young Chris Dodd; I think his pounding on protectionism could be a good tactic.&nbsp; But he also still has no chance.
<p>
Gilmore: My notes say Jim Gilmore participated in this debate.&nbsp; I can neither confirm nor deny that, as I have no recollection of his participation.
<p>
Huckabee: B-plus.&nbsp; Probably the most impressive of the second tier candidates.
<p>
Tommy Thompson: F.&nbsp; I honestly still don&#8217;t know what Thompson thinks he&#8217;s doing, unless he&#8217;s hoping to be confused with Fred Thompson by voters.
<p>
Paul: B.&nbsp; Had some good moments, and should lock up 100% of American libertarians.&nbsp; Unfortunately, that means he has 1% of the vote locked up solidly, and the other 99% of the vote pretty freaked out by him.
<p>
Chris Matthews: B-minus.&nbsp; Questions were tough, but actual questions.&nbsp; Didn&#8217;t have the &#8220;random baseless assertion&#8221; section that Brian Williams decided to go with last week.&nbsp; Still Chris Matthews, so still periodically so annoying as to make you want to jump off a cliff, but for Chris Matthews, pretty good.
<p>
Fred Thompson and Newt Gingrich: A.&nbsp; Not showing up won&#8217;t hurt them.&nbsp; Indeed, not showing up may be their best strategy for some time.
<p>
George W. Bush: F.&nbsp; Look, the GOP field can&#8217;t get too down on the Commander Guy because hey, he&#8217;s the Commander Guy.&nbsp; John Hinderaker would plotz.&nbsp; But they were as hard on him as they could be.&nbsp; Clearly, the Republicans know that this is a bad period for them.

And finally, the last word goes to Fred Thompson, who tells Minnesota Monitor, &#8220;By God, if you call me Harry once more, you&#8217;ll be busting counterfeiters in Alaska!&#8221;
